Somali electoral commission accepts Supreme Court ruling annulling Galmudug election results

Mogadishu (HOL) — Somalia’s Independent National Electoral and Boundaries Commission (NIEBC) has accepted the Supreme Court’s decision to annul last month’s House of Representatives and local council elections in Galmudug State.

In a statement on Wednesday, the commission said it would comply with the ruling in accordance with the Constitution and its own regulations.

“The Commission, considering the constitutional role of the Supreme Court, the supremacy of law and the resolution of electoral disputes through a legal judicial process in accordance with Article 73 of the National Electoral Act, which specifies the Supreme Court’s authority to adjudicate and decide on electoral matters, has accepted the decision of the Supreme Court of the Federal Republic of Somalia regarding the disputed elections in Galmudug State,” the statement said.

The commission said it would announce a new date and timetable for simultaneous elections for Galmudug’s local councils and House of Representatives.

Chief Justice Bashe Yusuf Ahmed said the administration and conduct of the elections had deviated from constitutional principles requiring free, fair and impartial elections.

The court said the irregularities identified were not minor, but had seriously undermined the transparency, freedom and fairness of the elections and affected their outcome.

The case was filed by the Towfiiq political organization, one of the groups that contested the Galmudug elections.

Towfiiq Party Chairman Sheikh Mohamed Shakir Ali Hassan welcomed the ruling, saying the court had considered the party’s complaints about the election results.

The Supreme Court ruling followed complaints by Towfiiq and other political organizations that alleged the Galmudug elections were not conducted in line with electoral laws and procedures.
